Menakar Keabsahan Affiliate Marketing dalam Hukum Muamalah

Abstract

The development of digital technology has given to various new business models, one of which is affiliate marketing, a marketing system that provides commissions to individuals who promote other parties’ products or services through digital media. This study aims to analyze affiliate marketing practices from the perspective of Muamalah law (Islamic commercial law). It employs a library research method with a qualitative descriptive approach, examining literature on affiliate marketing concepts such as TikTok Affiliate, and Shopee Affiliate. The findings indicate that affiliate marketing can be analogized to the contracts of wakālah (agency), ju‘ālah (reward for a specific task), or samsarah (brokerage). Such practices are permissible in Islam provided they adhere to principles of honesty, trustworthiness amanah, and fairness, and are free from elements of riba (usury), gharar (uncertainty/ambiguity), maysir (gambling/speculation), and tadlīs (deception). Furthermore, clarity regarding the contract, commission transparency, and clear product information are essential to prevent harm to other parties. Thus, affiliate marketing can constitute a halal digital economic activity when conducted in accordance with Muamalah legal principles.
